Unfortunately, there are times when you must go about terminating a disabled worker for reasons other than their disability. To protect company performance, you should terminate difficult employees as quickly as possible. You should not give a jobholder whom you sack "for cause" any recommendations. No jury will find it reasonable to terminate a worker for some isolated events. Make sure all of your communications with this employee are clear and in writing. Never depend on the formal definition of this law to protect you from a unlawful layoff suit. You may choose a recorded reprimand memorandum or a notification that is a little less documented yet informative to the worker.
